Terms of Service
These Terms govern your use of Orveil. By creating an account, using the Service, or sending galleries through Orveil, you agree to these Terms.
You keep ownership of your work. You are responsible for what you upload and deliver. You cannot abuse the platform, break the law, or use Orveil to violate someone else’s rights. We may change or suspend parts of the Service, and the Service is provided on an “as is” basis.
1. Eligibility and accounts
You must be old enough to form a binding contract where you live, and in any event at least 13 years old to use the Service. If you are under the age of majority, you may use Orveil only with parent or guardian permission.
You are responsible for keeping your account credentials secure and for activity that happens through your account unless caused by our own security failure.
2. What Orveil provides
Orveil is a creative project and gallery delivery platform for photographers, filmmakers, and other creative professionals. Features may include project organization, file storage, gallery delivery, branding controls, client selection tools, delivery messaging, and related workflow features.
We may add, change, suspend, or remove features over time.
3. Your content stays yours
You keep ownership of the files, images, video, text, branding assets, and other content you upload to Orveil.
You give Orveil a limited license to host, process, transmit, display, and back up your content only as needed to operate the Service for you. That license ends when your content is deleted from the Service, subject to ordinary backup and legal retention windows.
4. What you promise when using Orveil
- You have the rights, permissions, and authority needed to upload and deliver the content you use with Orveil.
- You will not use Orveil to violate privacy, publicity, copyright, trademark, or other rights.
- You will not upload unlawful, abusive, fraudulent, harmful, or malicious content.
- You will not attempt to interfere with the security, integrity, or availability of the Service.
- You will not use Orveil to send spam, phishing, malware, or other abusive traffic.
5. Client delivery responsibilities
If you use Orveil to deliver galleries or invite collaborators, you are responsible for the recipients and for the lawfulness of that communication. You are also responsible for the terms of your relationship with your own clients.
We provide the delivery tooling. We are not a party to your agreement with your clients.
6. Plans, storage, and billing
Orveil offers free and paid plans with different storage and feature limits. Paid plans are billed on a monthly or one-time lifetime basis. Plan terms, renewal details, and pricing are disclosed at the time of purchase. Payments are processed by our payment provider, Stripe; by purchasing a paid plan you also agree to Stripe's applicable terms.
Monthly plans renew automatically until cancelled. You may upgrade, downgrade, or cancel at any time from your account; cancellation stops future renewals and your paid features remain active through the end of the current billing period. Except where required by law, payments and lifetime purchases are non-refundable.
We may limit uploads or usage if your account exceeds the storage or feature limits of your current plan.
7. Intellectual property in the platform
Orveil, its software, interface, branding, and platform materials are owned by Orveil or its licensors and are protected by intellectual property law. These Terms do not give you ownership of the Service itself.
8. Suspension and termination
We may suspend or terminate access if you violate these Terms, create legal or security risk, abuse the platform, or if continuing to provide the Service would create material risk to Orveil or others.
You may stop using the Service at any time. If you request account deletion, we will handle your data in line with the Privacy Policy.
9. Disclaimers
Orveil is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
10. Limitation of liability
To the fullest extent permitted by law, Orveil will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill arising from or related to the Service.
To the fullest extent permitted by law, Orveil’s total liability for claims arising out of or related to the Service will not exceed the greater of the amount you paid Orveil in the 12 months before the claim arose or USD $100.
11. Governing law
These Terms are governed by the laws of North Carolina, United States, without regard to conflict-of-law rules, except where applicable law requires otherwise.
12. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the effective date and provide notice through the Service or by email where appropriate. By continuing to use Orveil after the updated Terms take effect, you agree to the updated Terms.
